1. Agreement to Terms

By accessing or using youryearbydesign.com (the “Site”), joining the Your Year, By Design™ program, downloading any workbooks, frameworks, or resources, or participating in live facilitated sessions or video content, you agree to be bound by these Terms of Use. These Terms apply to all visitors, participants, and users. If you do not agree to these Terms, you must immediately discontinue use of the Site and the program.

Your Year, By Design™ is owned and operated by Andrea Florescu (“Company,” “we,” “us,” or “our”).

2. The Program and Services

Your Year, By Design™ provides a structured planning and execution system involving quarterly touchpoints (January, April, July, October, December), downloadable workbooks, and live or recorded video content.

As the program is currently offered free of charge, we reserve the right to:

  • Modify, suspend, or cancel any session, resource, or the program in its entirety at any time without notice.
  • Change the format or delivery method of any content.
  • Refuse or terminate access to any participant at our sole discretion.

Because the program is provided for free, no compensation, credits, or refunds shall be issued for any changes or service interruptions.

3. Intellectual Property Rights

All content provided through the Site and program—including but not limited to the “Your Year, By Design™” name, the “Will, Way, When” framework, “Andrea-isms,” workbooks, videos, graphics, logos, and proprietary execution rhythms—is the exclusive intellectual property of Andrea Florescu and is protected by copyright, trademark, and other intellectual property laws.

A. Limited License

We grant you a non-exclusive, non-transferable, revocable license to access and use our materials for your own personal development or for the internal planning of your own business.

B. Prohibited Commercial Use

You are strictly prohibited from:

  • Selling, leasing, or sub-licensing any program materials or frameworks.
  • Using the “Will, Way, When” framework or any “Your Year, By Design™” content to provide coaching, consulting, or planning services to third-party clients for commercial gain.
  • Rebranding or creating derivative works based on our proprietary materials.
  • Removing or obscuring any copyright or trademark notices from our workbooks or digital assets.

4. Live Session Conduct

Participation in live facilitated sessions (via Zoom or other platforms) is a privilege, not a right. You agree to maintain a professional and respectful demeanor. We reserve the right to immediately remove and permanently ban any participant from live sessions or the program who:

  • Engages in harassment, hate speech, or disruptive behavior.
  • Uses the live session platform to solicit other participants for commercial purposes (spamming).
  • Records or distributes live session footage without express written consent from Andrea Florescu.

5. No Coaching or Professional Advice

Your Year, By Design™ is an educational framework and execution system only. It is NOT a coaching program.

Nothing in the program or on the Site constitutes professional, legal, financial, medical, or psychological advice. Andrea Florescu is not acting as your coach, therapist, attorney, or financial advisor. Results depend entirely on your own effort, consistency, and individual circumstances. We make no guarantees regarding specific outcomes or the achievement of your goals.

6. Third-Party Tools and Links

We may recommend or link to third-party tools (e.g., Google Calendar, Notion, Zoom, or ConvertKit). We do not control these third parties and are not responsible for their availability, data practices, or any technical failures that may occur while using them in conjunction with our program.

7. Limitation of Liability

To the maximum extent permitted by law, Andrea Florescu and Your Year, By Design™ shall not be liable for any direct, indirect, incidental, or consequential damages arising from your participation in the program or use of the Site.

Because the program is provided free of charge, our total liability to you for any claim arising out of these Terms or your use of the program is $0.00.

8. Indemnification

You agree to indemnify and hold harmless Andrea Florescu and Your Year, By Design™ from any claims, damages, or legal fees arising from your breach of these Terms, your misuse of our intellectual property, or your conduct during live sessions.

9. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that specific provision shall be deemed severed from the agreement, and the remaining provisions shall continue in full force and effect.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, USA, without regard to conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the courts located in Washington State.
